Unfenced - Terms of Service
Provider: Unfenced (the "Service") is operated by an independent sole trader based in Israel ("Unfenced", "we", "us", "our"). Unfenced is not an incorporated company. Legal notices: legal@unfenced.ai.
Last updated: 17 September 2026
Unfenced is in private preview. The Service is experimental, provided free of charge, and offered only to business and professional users. It carries no warranty, no service level, and no guarantee that anything you store in it will still be there tomorrow. Section 3 sets out what that means in practice, and it is the most important section in this document. If you are not willing to run the Service on those terms, do not request access.
1. Acceptance of these terms
These Terms of Service (the "Terms") govern your access to and use of the Unfenced service, including the hosted API, the Model Context Protocol (MCP) server, the SDK, the command-line client, and the web dashboard (together, the "Service"). By creating an account, connecting an agent, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization, and "you" refers to that organization.
1.1 Who may use the Service
The Service is offered solely to persons acting in the course of a trade, business, craft, or profession. By requesting access, creating an account, or connecting an agent, you represent and warrant that you are doing so in that capacity and not as a consumer.
The Service is not offered to consumers and is not intended for personal, family, or household use. It is not directed at children, and you must be at least 18 years old (or the age of majority where you live).
If you are a consumer, you have no right to use the Service, and we may terminate your access at any time. Nothing in these Terms is intended to exclude or limit any right you may have that cannot be excluded or limited by law.
2. What the Service does
Unfenced gives software agents structured access to the web. There are two distinct capabilities, and they carry different obligations for you:
- Reading the web. The Service fetches a URL you or your agent supplies, loads it through a real browser on a real IP address when needed, and returns clean Markdown or JSON instead of raw HTML. This is a read operation.
- Acting with delegated authority. The Service can drive a live browser session that is signed in _as you_ on a third-party website - for example to pass a login wall, dismiss a cookie banner, paginate, or complete a form on your behalf. This is a write/act operation and is governed by Sections 5 and 6 and by the Acceptable Use Policy.
The Service is a tool that carries out instructions you or your agent give it. It does not independently decide which sites to access or what to do there.
3. The preview, and your account
3.1 What you are accepting by using a preview
The Service is experimental software in private preview. You acknowledge and accept each of the following as a condition of using it:
- It may stop working, or stop existing. We may change, suspend, degrade, or withdraw the Service in whole or in part, at any time, for any reason, with no notice and no liability. We are under no obligation to continue offering it.
- Your data may be lost. Stored credentials, sessions, recordings, fetch history, and account data may be lost, corrupted, or deleted, including without warning and including permanently. You are responsible for keeping your own copies of anything you cannot afford to lose. Any backup we happen to run is for our operational convenience and is not a promise to you.
- There is no service level and no support commitment. No uptime target, no response time, no guarantee that a fault will be fixed.
- Results may be wrong. Retrieved content may be incomplete, stale, truncated, mis-extracted, or not the page you asked for. An automated action may fail silently, act on the wrong element, or complete only in part.
- Third-party sites may penalise you. The Service operates on sites belonging to other people, under your authority. Those sites may detect automation and may rate-limit, block, suspend, or permanently terminate the account you used, and may pursue you for breach of their own terms. That risk is yours, and you accept it each time you authorise a site.
- It must not be used where failure matters. You will not use the Service for any purpose where an error, delay, outage, or unintended action could cause death, personal injury, physical or environmental damage, regulatory breach, or material financial loss. It is not designed, tested, or offered for such use.
You accept that the Service is provided on this basis in exchange for access to it at no charge, and that its price reflects the absence of these assurances.
3.2 You decide what it does
The Service executes instructions you or your agents give it. It does not choose which sites to read, which sites to act on, which accounts to use, or what to submit. You are the operator of everything the Service does under your authority, and as between you and us that responsibility is yours in full.
Where your instructions cause the Service to retrieve or process personal data about other people, you are the controller of that processing and we act as your processor, on the terms of the Data Processing Addendum. Deciding whether you have a lawful basis for it is your responsibility, not ours.
3.3 Your account
- You are responsible for the security of your account credentials and access tokens (including the API key used by your agents and the dashboard access token stored in your browser). Treat them like passwords.
- You are responsible for everything done through your account, whether by you, by an agent you connect, or by anyone you give access to.
- You must give accurate account information and keep it current.
- The Service is currently offered by Unfenced in a limited or private preview. Access may be gated by an allowlist, and we may decline or revoke access at our discretion during preview.
4. Acceptable use
Your use of the Service is subject to the Acceptable Use Policy ("AUP"), which is part of these Terms. The AUP governs, in particular, what you may and may not do with the delegated-authority capability described in Section 2.2. A breach of the AUP is a breach of these Terms.
5. Delegated authority - your warranties
The act capability lets the Service operate on third-party sites while authenticated as you. This is powerful, and it only works because you have explicitly authorized each site through the owner-controlled act-allowlist: the Service will not act on a site you have not added, and neither you nor your agent can grant a site to itself without an authorization step you control.
Because you are directing action on services that belong to other parties, you represent and warrant, each time you authorize a site and each time your agent acts on it, that:
- You have the right to grant access. You own the account being used, or you are authorized by the account owner to access it and to have an automated agent act on it.
- You will not violate third-party terms. Your use will not breach the terms of service, robots directives, technical protection measures, or acceptable-use rules of the sites you direct the Service to access, except where such terms are unenforceable as a matter of law.
- You will not misuse credentials or data. You will not use the Service to access accounts you do not control, to harvest credentials or personal data you have no right to, or to circumvent authentication or access controls that are not yours to circumvent.
- You will comply with law. Your use complies with all applicable laws, including computer-misuse, anti-hacking, data-protection, intellectual-property, and anti-spam laws.
You direct and control what the Service does on your behalf. As between you and us, you are the operator of the actions the Service takes under your authority, and you are responsible for them.
6. Credentials and sessions you give us
To act on your behalf, you may store website passwords, one-time-password (TOTP) seeds, and logged-in browser sessions with the Service. How we handle them is described in the Privacy Policy. In summary, and as part of these Terms:
- Stored passwords, TOTP seeds, and session cookie jars are encrypted at rest with AES-256-GCM.
- Persistent secrets are never exposed to the AI model. Your agent works with a credential _name_; the Service resolves the actual secret server-side and fills it into the page. There is no API that reveals a stored secret back to you or to an agent.
- One narrow exception exists for a single-use one-time 2FA code you choose to hand the agent in the moment (for a login wall with no stored seed). It is shape-checked so a password cannot be passed this way, kept out of session replay, and logged only as a kind and reference.
- You are responsible for having the right to store and use any credential you give us, and for removing credentials you no longer have the right to use.
If you allow dashboard analytics, PostHog and Microsoft Clarity may record your dashboard interactions. Input values, displayed API keys, and token-bearing links are masked in those recordings; other dashboard text may remain visible. The Cookie Notice describes this recording and how to withdraw analytics consent.
7. Fees and billing
- The Service records usage (for example, fetches and session time) as usage events for metering purposes.
- Paid billing is not yet live. During the current preview the Service may be provided free of charge or on invited terms. When paid plans are introduced, pricing, billing cycles, taxes, and payment terms will be published on the Unfenced pricing page and presented to you before any charge, and continued use after that point constitutes acceptance of the applicable fees.
- We may meter and rate-limit usage to protect the Service, as described in the AUP.
8. Intellectual property
- We and our licensors own the Service, including its software, design, and documentation. These Terms grant you a limited, non-exclusive, non-transferable, revocable right to use the Service in accordance with them.
- Content the Service retrieves from third-party sites belongs to its respective owners. We claim no ownership of it and grant you no rights in it; your right to use retrieved content is a matter between you and the source.
- You retain ownership of the instructions, prompts, and configuration you provide. You grant us the limited right to process them as needed to operate the Service.
9. Third-party services
The Service relies on subprocessors listed in subprocessors.md and, in operation, interacts with the third-party websites you direct it to. We are not responsible for third-party websites, their content, their availability, or their treatment of your account on them.
10. Disclaimers of warranty
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE SPECIFICALLY DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
Without limiting the above, we do not warrant that:
- the Service will be uninterrupted, timely, secure, or error-free;
- any particular URL will be reachable, or that retrieved content will be accurate, complete, or up to date;
- an automated action on a third-party site will succeed, or will not be blocked, reversed, or penalized by that site; or
- the Service is suitable for any use where failure could cause loss of life, personal injury, or severe physical or environmental damage.
The Service is a general-purpose automation tool. You are responsible for deciding whether it is appropriate for your use case and for supervising the actions your agents take through it.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) EUR 100.
During the preview the Service is provided free of charge, so (A) is nil and the cap is EUR 100 in aggregate. You acknowledge that this allocation of risk is a basis of the bargain, that it reflects the absence of any fee, and that we would not make the Service available to you on any other terms.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
12. Indemnity
To the extent permitted by law, you will defend, indemnify, and hold us harmless from and against claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:
- your use of the Service, including any action the Service takes under your delegated authority;
- your breach of these Terms or the AUP;
- your breach of your warranties in Section 5, including any claim by a third-party site that access was unauthorized or violated its terms; or
- your violation of any law or third-party right.
13. Suspension and termination
- You may stop using the Service at any time and may delete your account and data as described in the Privacy Policy.
- We may suspend or terminate your access, with or without notice, if we reasonably believe you have breached these Terms or the AUP, if required to protect the Service or third parties, or if required by law. Where practical and lawful, we will give notice and an opportunity to cure.
- We may delete your data on termination. On termination or on closure of the preview we may delete your account and everything in it, including stored credentials, sessions, and recordings, without further notice. Export anything you need first.
- On termination, your right to use the Service ends. Sections that by their nature should survive (including Sections 3, 5, 6, 8, 10, 11, 12, 15, and 16) survive.
14. Changes to the Service and to these Terms
We may change the Service and these Terms. For material changes to these Terms we will give reasonable notice (for example, by email or an in-product notice) before they take effect. Continued use after the effective date constitutes acceptance. If you do not agree to a change, stop using the Service.
15. Governing law and disputes
These Terms are governed by the laws of Israel, without regard to its conflict-of-laws rules. The competent courts of Tel Aviv-Yafo, Israel have exclusive jurisdiction over any dispute arising out of or related to these Terms or the Service, except that either party may seek injunctive relief in any court of competent jurisdiction.
The Service is offered only to business and professional users (Section 1.1), so no consumer-forum rules are intended to apply. If a mandatory rule of your local law nevertheless gives you a right to bring proceedings elsewhere, this clause does not remove it.
16. General
- Entire agreement. These Terms, the AUP, and the Privacy Policy are the entire agreement between you and us about the Service.
- Severability. If a provision is unenforceable, the rest remains in effect.
- No waiver. Failure to enforce a provision is not a waiver of it.
- Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
- Notices / contact. Legal notices to legal@unfenced.ai; abuse and takedown reports to abuse@unfenced.ai (see the Abuse & Takedown policy). We will identify the operator in response to a properly constituted legal request.
- Force majeure. We are not liable for any failure or delay caused by anything beyond our reasonable control, including the acts of third-party websites, network or hosting failures, and changes to the anti-automation measures the Service contends with.
- No partnership. Nothing in these Terms creates a partnership, agency, employment, or joint venture between us.
